Title XXXIX CONDUCT OF PUBLIC BUSINESS

Until December 31, 2016 — Failure to comply with expungement order, penalty — knowingly using expunged record for gain, penalty. — 1. A person subject to an order of the court in subsection 4 of section 610.123 who knowingly fails to expunge or obliterate, or releases arrest information which has been ordered expunged pursuant to section 610.123 is guilty of a class B misdemeanor.
2. A person subject to an order of the court in subsection 4 of section 610.123 who, knowing the records have been ordered expunged, uses the arrest information for financial gain is guilty of a class D felony.
