Title XXXVIII CRIMES AND PUNISHMENT; PEACE OFFICERS AND PUBLIC DEFENDERS
< > Effective - 28 Aug 2013, 2 histories, see footnote (history)*578.389. Until December 31, 2016 — Enhanced penalty for multiple convictions. — 1. Every person who has been previously convicted of two violations in section** 578.385 or 578.387, or any two of them shall, upon a subsequent conviction of any of these offenses, be guilty of a class C felony and shall be punished accordingly.
2. Evidence of prior convictions shall be heard by the court, out of the hearing of the jury, prior to the submission of the case to the jury, and the court shall determine the existence of the prior convictions.
