Chapter 233

  233.425.  Dissolution of road district — petition — notice — dissolution vote, Bates County, when. — 1.  Whenever a petition, signed by the owners of a majority of the acres of land owned by residents of the county residing within the district organized under the provisions of sections 233.320 to 233.445, shall be filed with the county commission of any county in which such district is situated, setting forth the name of the district and the number of acres owned by each signer of such petition and the whole number of acres in such district, the county commission shall have power, if in its opinion the public good will be thereby advanced, to disincorporate such road district.  No such road district shall be disincorporated until notice is published in at least one newspaper of general circulation in the county where the district is situated for four weeks successively prior to the hearing of such petition.

  2.  Notwithstanding any provision of law to the contrary, any special road district located in any county with more than fifteen thousand seven hundred but fewer than seventeen thousand six hundred inhabitants and with a county seat with more than four thousand two hundred ten but fewer than six thousand inhabitants shall have placed on the ballot by no later than the general election in November 2026 whether to dissolve such special road district. If the voters approve such question to dissolve the special road district, the responsibilities and outstanding obligations of the district shall be transferred to the county.
