Title XXXVIII CRIMES AND PUNISHMENT; PEACE OFFICERS AND PUBLIC DEFENDERS
< > • Effective - 28 Aug 2014, 2 histories595.036. Grievances, decision of department, appeal to administrative hearing commission. — 1. For any claim filed on or after August 28, 2014, any party aggrieved by a decision of the department of public safety on a claim under the provisions of sections 595.010 to 595.075 may, within thirty days following the date of notification of such decision, file a petition with the department to have such decision heard de novo by the director. The director may affirm or reverse the department's decision on the basis of the evidence previously submitted in such case or may take additional evidence in reviewing the decision. The department shall promptly notify the party of its decision and the reasons therefor.
2. Any party aggrieved by the department's decision may, within thirty days following the date of notification of such decision, file a petition with the administrative hearing commission to appeal such decision as provided in section 621.275.
