Title XXXI TRUSTS AND ESTATES OF DECEDENTS AND PERSONS UNDER DISABILITY

Judgment for defendant, when. — If it appears that the state has no title in such estate, the defendant shall recover his or her costs, to be taxed and certified by the clerk, provided that the court find, from the facts, that the title to such estate is in the defendant. When such certificate of the clerk is filed in his or her office, the state treasurer shall pay the certificate as other demands on the treasury.
