  *128.348.  Congressional districts to be established. — 1.  Effective with the election for the 113th Congress and through the election of the 117th Congress, the state of Missouri shall consist of eight congressional districts.

  2.  Effective with the election of the 118th Congress, the state of Missouri shall consist of eight congressional districts.

  3.  Effective with the election of the 120th Congress, the state of Missouri shall consist of eight congressional districts.

  4.  The legal voters of each district shall elect one member of Congress of the United States.

*Revisor's Note:  On September 29, 2025, a petition for referendum (Chapter 116, RSMo) on House Bill No. 1 as enacted by the 103rd General Assembly, 2nd Extraordinary Session of the 1st Regular Session was received by the Secretary of State's Office.  On November 13, 2025, the official ballot title was certified by the Secretary of State (Section 116.180, RSMo) and approved for circulation in accordance with Article III, Section 52(a) of the Missouri Constitution.

On December 9, 2025, the Secretary of State's Office received 691 boxes of referendum petitions for House Bill No. 1.  The submitted petition signatures are subject to verification by election authorities and the Secretary of State.

On August 4, 2026, the Secretary of State issued a Certificate of Insufficiency of Petition.

On September 3, 2026, the Missouri Supreme Court ruled that the Missouri Constitution authorizes a referendum on congressional redistricting passed by the General Assembly.  The court found the referendum petition for H.B. 1 as enacted by the 103rd General Assembly, Second Extraordinary Session (2025), was legal, sufficient, and timely, therefore H.B. 1 will not go into effect unless and until approved by the voters.  The congressional districts established by the General Assembly in 2022 remain in full force and effect for the November 2026 general election.  (See annotation below)

(2026) The Missouri Constitution authorizes a referendum on congressional redistricting passed by the General Assembly.  The referendum petition for H.B. 1, 103rd General Assembly, Second Extraordinary Session (2025), was legal, sufficient, and timely.  H.B. 1 did not go into effect and will not go into effect unless and until approved by the voters.  The congressional districts the General Assembly established in 2022 remain in full force and effect for the November 2026 general election.  Glahn v.
