195.819. Consumer identifying information, record retention prohibited — violation, fine. — Marijuana dispensary facilities, as described in Article XIV of the Constitution of Missouri, shall not create or retain any record containing the consumer's identifying information; provided, that a facility may create or retain such records if the consumer affirmatively agrees to such, in writing, and if the facility does not refuse to provide services or sell goods to the consumer if he or she does not agree to the creation or retention of such records. The provisions of this section shall not apply to any record-keeping requirements relating to qualifying patients and primary caregivers under Article XIV, Section 1 of the Constitution of Missouri. Any dispensary facility that violates the provisions of this section shall be assessed a five hundred dollar fine per occurrence.
